Terms of use

The rules for using Uttermost. Short version: use it to pray for people, be careful with what you write about them, and keep your phone secure.

1. Agreement

These terms are an agreement between you and Dylan Bono ("we", "us") for the Uttermost app and this website. By downloading or using Uttermost, you agree to them. Uttermost is also licensed to you under Apple's Licensed Application End User License Agreement. If the two conflict, these terms apply to the extent the law allows.

2. Your license

We give you a personal, non-exclusive, non-transferable license to use Uttermost on Apple devices you own or control, as allowed by the App Store's usage rules. You may not copy, modify, resell or redistribute the app, or try to reverse engineer it, except where the law allows it.

3. What Uttermost is for

Uttermost is a personal prayer list for the missionaries, families and ministries you support. It's meant for your own use, to help you pray and to remember what you've prayed for.

4. What you enter about others

The names, places and prayer requests you enter are about real people, and some of them may serve where their work isn't safe to talk about. You're responsible for what you enter and who you show it to. Please respect what people share with you in confidence, and for anyone in a sensitive place, use an alias and a general location rather than an exact one.

5. Your data

What you enter belongs to you and stays on your device, as described in our privacy policy. Uttermost doesn't sync to a server, so you're responsible for keeping your own backups. If you delete the app or lose your device without a backup, your list may be lost.

6. Maps and places

Maps, place names and search results come from Apple Maps. Borders, names and the local times shown in Uttermost are approximate and may not be complete or current. They're there to help you pray, not to navigate or make decisions with.

7. Purchases

If Uttermost offers in-app purchases, they're sold through the App Store and governed by Apple's terms. Refunds are handled by Apple under its policies.

8. Ownership

The Uttermost name, icon, design and software belong to Dylan Bono. Map data and imagery belong to Apple and its providers.

9. No warranty

Uttermost is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We don't promise the app will be error-free or always available.

10. Limit of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special or consequential damages, or for lost data, arising from your use of Uttermost, including harm resulting from someone else seeing what you've entered. Our total liability for any claim is limited to the amount you paid for Uttermost, if anything.

11. Apple

• These terms are between you and us, not Apple. We, not Apple, are responsible for Uttermost and its content.
• Apple has no obligation to provide maintenance or support for Uttermost.
• If Uttermost fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for Uttermost.
• We, not Apple, are responsible for addressing any claims relating to Uttermost, including product liability claims, claims that Uttermost fails to meet a legal or regulatory requirement, consumer protection claims and claims that Uttermost infringes someone's intellectual property.
• You confirm that you aren't located in a country subject to a U.S. Government embargo and aren't on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Ending these terms

You can stop using Uttermost at any time by deleting it. If you break these terms, your license ends automatically.

13. Governing law

These terms are governed by the laws of the State of South Carolina, United States, without regard to conflict-of-law rules.

14. Changes

We may update these terms. We'll post the new version here and change the date at the top. Using Uttermost after a change means you accept the updated terms.
